1. Acceptance of terms

By accessing or using the Unclogmind website or placing an order, you agree to be bound by these Terms of Service. If you do not agree, please do not use this site.

2. The Unclogmind marketplace (clothing)

Unclogmind is an online marketplace for clothing. We provide the website, and independent sellers ("Listers") pay Unclogmind a listing fee to display their own clothing through it. Unclogmind is not the manufacturer, owner, or seller of any clothing listed on this site, and Unclogmind and each Lister are separate, independent entities. Listing on Unclogmind does not make a Lister an employee, partner, agent, or representative of Unclogmind, and nothing on this site should be read as implying that relationship.

Unclogmind does not process payment and is not involved in completing a sale. Selecting a clothing item connects you directly with the Lister, currently over WhatsApp, to discuss the item, agree a price, arrange payment, and arrange delivery between yourselves. The resulting sale is a private transaction between you and the Lister. Your contract of sale is with that Lister, not with Unclogmind, and Unclogmind has no visibility into the price you agree, the payment method you use, or whether the transaction is ever completed.

The Lister is solely responsible for the accuracy of their listing, the quality, safety, and legality of the product, fulfilling and shipping the order, and resolving any problem with it, including damaged, defective, missing, or misdescribed items, and any return, exchange, or refund.

Because Unclogmind is not part of the transaction, we cannot verify a Lister's identity beyond what they provide when listing, mediate a payment dispute, or recover money sent directly to a Lister. Deal directly with Listers at your own risk: avoid paying in full before you've agreed on delivery details in writing, be cautious of prices that seem unrealistically low, and use a payment method that gives you some recourse where possible. If something feels wrong about a conversation, stop and contact us.

Unclogmind is not responsible or liable for any Lister's products, conduct, fulfillment of an order, or any payment made directly to a Lister, and cannot be held responsible in place of the Lister for a dispute about an order. If you have a problem with an order, contact the Lister who fulfilled it first, using the same WhatsApp conversation or other contact details you used to buy. If you're unable to resolve it directly, you can also reach Unclogmind support and we'll try to help, but Unclogmind is not a party to the underlying transaction and cannot guarantee an outcome.

Every Lister accepts a separate Lister Agreement before they can list on Unclogmind, which requires them to ship only within Africa and to handle order problems directly, among other obligations.

3. Book recommendations and affiliate links

Books shown on Unclogmind are not sold by Unclogmind or by a Lister. They are recommendations that link out to a third-party retailer's own website, where the purchase actually takes place. These are affiliate links: if you buy a book after clicking one of our links, the retailer may pay Unclogmind a commission. This costs you nothing extra and does not affect the price you pay.

Once you click through to a retailer's site, that retailer's own terms of service, pricing, availability, shipping, returns policy, and privacy practices apply, not Unclogmind's. Unclogmind does not control and is not responsible for the retailer's site, the accuracy of a book's listing there, whether an order is fulfilled, or any issue with a book purchase. Any dispute about a book purchase should be raised directly with the retailer you bought it from.

4. Products and availability

Listers list clothing, often in limited drops. Items may sell out, and neither the Lister nor Unclogmind guarantees that any product will be restocked. A Lister may limit the quantity of any item sold to any person.

5. Pricing and payment

Prices shown on a clothing listing are set by the Lister, typically in Nigerian Naira (NGN), and are a starting point, not a checkout price; the final price is whatever you and the Lister agree to directly. Unclogmind does not process, collect, or hold any payment for clothing, and has no visibility into how you pay a Lister. You are responsible for choosing how you pay and for confirming the details of a purchase with the Lister before sending any money. Book purchases are paid for entirely on the retailer's own site, under their pricing and payment terms.

6. Orders and cancellations

Because clothing purchases are agreed and paid for directly between you and the Lister, whether an order is confirmed, changed, or cancelled is between you and the Lister. Unclogmind does not hold payment and cannot issue a refund for a clothing purchase, since we're never in possession of the money. If you paid a Lister and the order falls through, you'll need to resolve that with the Lister directly, and can contact Unclogmind support if you're unable to. This section does not apply to books, which are ordered and paid for on the retailer's own site.

7. Shipping

Listers ship clothing within Nigeria and to other African countries only. We do not permit shipping clothing outside Africa. Because delivery is arranged directly between you and the Lister rather than through a checkout, shipping cost, timing, and method are whatever you and the Lister agree, and it is the Lister's responsibility to only agree to deliveries within Africa. Cross-border deliveries within Africa may be subject to customs fees, import duties, or taxes charged by the destination country, which are your responsibility. Once a package has left the Lister's hands, neither the Lister nor Unclogmind is responsible for delays caused by the shipping carrier or customs. Books are shipped by the retailer under their own shipping terms and coverage area, which may differ from this.

By arranging a delivery with a Lister, you confirm that your delivery address is within Africa. If a delivery address outside Africa is used, whether by mistake, a freight-forwarding or reshipping service, or an inaccurate address, that arrangement is outside what Unclogmind permits on this platform, and Unclogmind is not responsible for it or for anything that happens to the shipment afterward. You agree to indemnify and hold Unclogmind harmless from any claim, cost, loss, or expense arising from an inaccurate or out-of-scope delivery address you provided.

8. Returns and exchanges

Clothing sales are final once a Lister has shipped an item, except where it arrives damaged, defective, or different from what was agreed. In that case, contact the Lister you dealt with within 7 days of delivery, with photos of the issue, so they can arrange a replacement or refund at their discretion. If you can't reach the Lister, contact support@unclogmind.com and we'll try to help you get in touch with them, though Unclogmind cannot force a Lister to issue a refund since we never hold the payment.

This final-sale norm does not override any return or cancellation rights you may have under the mandatory consumer protection laws of your country or state, where those laws apply and cannot be waived. Book returns are handled entirely by the retailer you purchased from, under their own returns policy.

9. Account and conduct

If you create an account, you are responsible for keeping your login details secure. You agree not to use this site for any unlawful purpose or to attempt to disrupt or misuse it.

10. Intellectual property

All Unclogmind branding, site design, and site content are the property of Unclogmind. You may not copy, reproduce, or resell them without permission. Product designs, photos, and descriptions belong to the Lister who listed them, unless stated otherwise.

11. Limitation of liability

Unclogmind provides the marketplace platform and book recommendations only, and is not liable for any direct, indirect, incidental, or consequential damages arising from a clothing product you purchased from a Lister, a Lister's conduct, or a book you purchased from a third-party retailer through one of our affiliate links, to the fullest extent permitted by law. This limitation does not apply to Unclogmind's own conduct in operating the website itself, such as a payment or account issue caused directly by Unclogmind.

12. Changes to these terms

We may update these terms from time to time. Continued use of the site after a change means you accept the updated terms.

13. Governing law

These terms are governed by the laws of the Federal Republic of Nigeria.
